To sum up, we DISMISS for lack of jurisdiction Estrada s challenge to the Board s decision that his statutory rape conviction was a particularly serious crime. We also find, however, that, on the issue of deferral of removal under the Convention Against Torture, the Board failed to apply the correct standard of review to the immigration judge s finding that Estrada will likely face torture if he is removed to Honduras. In that respect we GRANT Estrada s petition and REMAND his case to the Board of Immigration Appeals for further proceedings consistent with this opinion. Daniel A.
