Filing 702728390 Filed Nonprecedential Disposition PER CURIAM. We note that Cobige filed this appeal after we issued our published opinion in Carter. Cobige was told that this case was taken in bad faith when the district court rightly denied him leave to appeal in forma pauperis. He ignored the district court. We thus order him to show cause why sanctions should not be imposed for filing a frivolous appeal and direct Cobige to respond within 14 days of the date of this order. See FED. R. APP. P. 38 ( If a court of appeals determines that an appeal is frivolous, it may, after . . . notice from the court and reasonable opportunity to respond, award just damages and single or double costs to the appellee. ). We caution future litigants who choose to file these frivolous lawsuits that the plaintiffs in Mimms were fined $1,000. The district court's judgment is AFFIRMED. Diane P. Wood, Chief Judge; Michael S. Kanne, Circuit Judge and Diane S. Sykes, Circuit Judge. Sent Certified Mail. Receipt Number: 70123460000090608769. [6738849-1] [6738849] [15-2446] |
