September 29, 2015 Opinion or Order Filing 11 ORDER re: 1. Motion to proceed on appeal in forma pauperis. 2. Memorandum in support of PLRA for leave to proceed on appeal in forma pauperis. A review of this case indicates that appellant Jimmy Hollins is not permitted to proceed in forma pauperis under 1915(g). Before filing this suit, Hollins had already incurred two strikes for bringing actions that were dismissed on the ground that they failed to state a claim upon which relief may be granted. See Hollins v. Vandersnick, No. 07-4051 (C.D. Ill. Oct. 22, 2007); Hollins v. Vandersnick, No. 07-4037 (C.D. Ill. Aug. 10, 2007). In dismissing Hollins's action in this case, the district court concluded that Hollins has garnered another strike. See Hollins v. Hamer, No. 14-4028 (C.D. Ill. July 17, 2015). After reviewing Hollins's motion for leave to proceed in forma pauperis and the record on appeal, we have determined that the district court correctly concluded that Hollins has incurred a strike in bringing this action. See Robinson v. Powell, 297 F.3d 540, 541 (7th Cir. 2002). Thus, Hollins may not proceed in forma pauperis because, on three or more prior occasions, he has brought an action that was dismissed on the grounds that it is frivolous, malicious, or fails to state a claim, and he has not demonstrated imminent danger of a serious physical injury. 28 U.S.C. 1915(g); see Taylor v. Watkins, 623 F.3d 483 (7th Cir. 2010). The motion for leave to proceed on appeal in forma pauperis is DENIED. See 28 U.S.C. 1915(g). The appellant shall pay the required docketing fee within 14 days or else this appeal will be dismissed for failure to prosecute pursuant to Circuit Rule 3(b). See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). [ # 7 ] Sent Certified Mail. Receipt Number: 70123460000090607748. [11] [6696134] ZXT [15-2750] (CMD) [Entered: 09/29/2015 12:18 PM]
