ORDER re: Appellant's February 1, 2019 Letter. On December 31, 2018, the appellant Kelvin Underwood filed a notice of appeal from the district court's judgment, and appeal no. 19-1029 was opened. On January 7, 2019, he filed an almost identical notice of appeal in the district court and a second appeal, no. 19-1057, was opened. Both filings seek to challenge the same district court judgment, and two separate appeals are not necessary. Accordingly, appeal no. 19-1057 is administratively CLOSED. No appellate filing fees for appeal no. 19-1057 shall be imposed. Further, the appellant's request for an extension is GRANTED. In appeal no. 19-1029 Underwood shall pay the appellate filing fees or file a motion to proceed in forma pauperis and a brief memorandum explaining why he contends the district court's denial of leave to proceed on appeal in forma pauperis is erroneous by March 4, 2019.
