Filing 2
ORDER: A preliminary review of the short record indicates that the district court denied appellant David Lewisbeys Motion to Reopen Time to Appeal because it was untimely. Section 2107(c) of Title 28 requires that appellants motion had to be filed within 14 days after receipt of the notice of entry of the judgment. Petitioner Lewisbeys motion to reopen did not meet this deadline. Accordingly, IT IS ORDERED that appellant Lewisbey shall file, on or before April 30, 2019, a brief memorandum stating why the district courts orders of February 28, 2019 and March 26, 2019 should not be summarily affirmed. A motion for voluntary dismissal pursuant to Fed. R. App. P. 42(b) will satisfy this requirement. Briefing shall be suspended pending further court order.
