Filing 4 ORDER re: Emergency petition. James Ademiju has filed an emergency petition, which this court has opened as a petition for review of his removal order and a motion for stay of removal. Ademiju has a pending petition for review in the Third Circuit Court of Appeals, and that court has stayed his removal and appointed counsel to represent him. Accordingly, to the extent that Ademiju is seeking a stay of removal from this court, IT IS ORDERED that the request is DENIED as unnecessary. To the extent that Ademiju is asking for injunctive relief related to the Notice from the U.S. Immigration and Customs Enforcement requiring him to appear for an interview on January 6, 2020, IT IS FURTHER ORDERED that the request is DENIED. Ademiju remains obligated to report to immigration authorities. IT IS FINALLY ORDERED that Ademiju and the government shall file memoranda by January 16, 2020, addressing whether this petition should be dismissed in light of Ademijus pending petition for review in the Third Circuit, or whether other action is necessary.
