March 3, 2020 Opinion or Order Filing 2 ORDER: In the present case, plaintiff-appellant Donald Lee Mains filed a letter on February 25, 2020, within 28 days of entry of judgment on February 18, 2020. The district court treated that letter as a Motion for Reconsideration, meaning that it appears to be a timely Rule 59 motion. See Obriecht v. Raemisch, 517 F.3d 489, 493-94 (7th Cir. 2008); Borrero v. City of Chicago, 456 F.3d 698, 699 (7th Cir. 2006); Charles v. Daley, 799 F.2d 343, 347 (7th Cir. 1986); see also Shales v. General Chauffeurs, Sales Drivers and Helpers Local Union No. 330, 557 F.3d 746, 748 (7th Cir. 2009). As such, this appeal may be premature, because it appears that the district court has not disposed of the motion and entered its order on the district court's civil docket. Accordingly, IT IS ORDERED that plaintiff-appellant Donald Lee Mains shall file, on or before March 18, 2020, a brief memorandum stating why this appeal should not be STAYED pending the entry of the order disposing of the motion. A motion for voluntary dismissal pursuant to Fed. R. App. P. 42(b) will satisfy this requirement. Briefing shall be suspended pending further court order.
