October 1, 2020 Opinion or Order Filing 45 ORDER re: 1. Revised motion to recuse and disqualify instanter the panel from hearing any matters related to this appeal/this appellant on the grounds of transparent, proved, bias, prejudice, partilaity, extreme conflict of interest. 2. Appellant's motion for third and final extension to file opening brief due to extenuating circumstance and motion to reconsider the denial of full extension sought in the motion for extension of time to file appellant's opending. Monica Shekar has filed another motion for the court to order the recusal of a panel that once ruled against her husband. This court denied one such motion on September 15, although it also construed a portion of the motion as a request to reconsider an earlier order. That order had granted in part Shekars request for an extension of time and said no further extensions would be granted, but the court reconsidered and offered an additional three-week extension. Shekar immediately objected to this construction of her motion and repeated her demand that the panel be ordered recused, but the court again denied her request. Because this court has already twice denied the relief Shekar seeks, this new motion is a repetitious motion to reconsider that could be rejected by the clerk under 7th Circuit Operating Procedure 1(c)(8), but it has nevertheless been presented to a judge. Whether under the operating procedures or on its merits, the motion to order recusal is again DENIED. Despite these denials, this motion and all of Shekars recent motions have, coincidentally, been ruled on by judges other than those she seeks to disqualify. Shekar has also filed a motion requesting a six-month extension of time to file her opening brief, though this court has twice said no further extensions will be granted. This motion is also DENIED. Shekar has not shown any extenuating circumstances that would prohibit her from filing a brief despite her best efforts. Instead, she has chosen to spend her time preparing these and other repetitious motions and, she says, a petition to have the Supreme Court review this courts denial of an earlier repetitious motion to reconsider. Shekars brief remains due on October 16, 2020. Until she submits a brief, the clerk of this court shall return unfiled any motions that Shekar may tender in this appeal. Failure to submit a brief by October 16 will lead to dismissal of this appeal for lack of prosecution pursuant to Circuit Rule 31(c)(2). [ # 43 ] [ # 44 ] Sent Certified Mail. Typo Corrected Appellant's Motion to Recuse and Disqualify Instanter the Panel Consisting of Cj. Easterbrook; Cj. Sykes; Cj. Barrett From Hearing Any Matters Related to this Appeal/this Appellant on the Grounds of Transparent, Proved Bias, Prejudice, Partiality, Extreme Conflict of Interest, which this court CONSTRUES as a motion to reconsider its 08/11/2020 order granting only in part appellant's motion for extension of time. [ # 37 ] The motion to reconsider is GRANTED only to the extent that Monica Shekar may file her appellate brief on or before 10/16/2020. This court previously ordered that no further extensions would be granted absent extenuating circumstances. Shekar failed to inform the court of her change in address, so a copy of that order was not sent to her current address until three weeks after the order issued. The court concludes that this delay qualifies as an extenuating circumstance and will grant an additional three-week extension. No further extensions will be granted. If Shekar does not locate counsel by 10/16, she is responsible for submitting a pro se brief. Failure to do so may lead to this appeal being dismissed for lack of prosecution pursuant to Circuit Rule 31(c)(2). IT IS FURTHER ORDERED that all other relief requested in the motion is DENIED. The remainder of briefing will proceed as follows: Appellee's brief due on or before 11/16/2020 for Ocwen Loan Servicing, LLC. April 20, 2020 Opinion or Order Filing 18 ORDER re: Motion to vacate and for clarification and issuance of a statement of reasons for the denial of the April 9, 2020 motion to lift and to add Roger Shekar as an appellant and motion for reconsideration. In this motion, appellant Monica Shekar requests a more complete statement of this courts reasoning for its April 9, 2020, order denying her renewed motion to lift the filing bar on Roger Shekar for the purpose of this appeal. She also requests reconsideration of the order after a hearing before a three-judge panel. IT IS ORDERED that the motion is DENIED. The exceptions to this courts filing bars are narrowly limited to the most liberty-restricting of circumstances: criminal cases and habeas petitions. Support Sys. Intl, Inc. v. Mack, 45 F.3d 185, 186 (7th Cir. 1995). This court considered other exceptions but rejected them. Id. at 18687. Further, Shekar is not entitled to a hearing, a three-judge panel, or a statement of reasons from this court. See FED. R. APP. P. 27(b),(c),(e); Courts Duties to Lawyers, STANDARDS FOR PROFESSIONAL CONDUCT WITHIN THE SEVENTH FEDERAL JUDICIAL CIRCUIT. Finally, this court provided an accounting and analysis of Roger Shekars outstanding filing fees in its March 27, 2020, order in case No. 17-2171. The issue may not be relitigated here. March 27, 2020 Opinion or Order Filing 7 ORDER re: Motion to lift. In her motion, appellant Monica Shekar asserts that she cannot receive full relief in this appeal without her husbands participation, notwithstanding a filing restriction that he earned through frivolous and abusive litigation before this court. Because she does not explain why these circumstances preclude full relief, IT IS ORDERED that the motion is DENIED without prejudice to renewal in a motion explaining why Mrs. Shekar cannot receive adequate relief as the sole appellant.
