July 23, 2020 Opinion or Order Filing 10 ORDER re: The papers filed in this appeal and review of the short record. IT IS ORDERED that this appeal is DISMISSED. Rule 4(a) of the Federal Rules of Appellate Procedure requires that a notice of appeal in a civil case in which the United States is a party be filed in the district court within 60 days of the entry of the judgment or order appealed. In this case judgment was entered on May 23, 2019, and the notice of appeal was filed on June 15, 2020, nearly one year late. The district court, on May 18, 2020, correctly denied a motion to reopen the appeal period (captioned as a Motion to Re-Enter Judgment) because it had no authority to do so the motion to re-open was untimely. See Rule 4(a)(6). And this court, of course, is not empowered to reopen the time to appeal. See Fed. R. App. P. 26(b). Daniel A. Manion, Circuit Judge; David F. Hamilton, Circuit Judge and Michael B. Brennan, Circuit Judge. [10] [7095925] [20-2041] (AG) [Entered: 07/23/2020 04:39 PM]
