Filing 7 ORDER re: Letter, filed on April 15, 2021, by pro se appellant. With respect to appeal 21-1309, a review of the court's docket indicates that on February 25, 2021, the district court granted the appellant's motion for leave to proceed on appeal in forma pauperis and assessed an initial partial filing fee of $47.19. On April 12, 2021, the appellant filed a motion to waive the initial partial filing fee, and that motion is currently pending. The appellant is reminded that this appeal is subject to the Prison Litigation Reform Act and, therefore, all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). Because the appellants fee status has not yet been resolved, the court has not set a briefing schedule. With respect to appeal 21-1310, a review of the courts docket indicates that on March 1, 2021, the district court granted the appellant's motion for leave to proceed on appeal in forma pauperis and assessed an initial partial filing fee of $47.19. On March 4, 2021, this court received confirmation from the district court that the appellant paid the initial partial filing fee. Accordingly, IT IS ORDERED that briefing in appeal 21-1310 will proceed as follows: Appellant's biref and required short appendix is due by May 19, 2021. Finally, the clerk will send the appellant a copy of the court's public docket for these appeals. [7] [7154563] CMD [21-1309, 21-1310] (ER) [Entered: 04/16/2021 02:18 PM] |
