Filing 15 Mandate issued. No record to be returned. [15] [7158789] [21-1525] (DRS) [Entered: 05/07/2021 09:17 AM] |
FOR COURT USE ONLY: Certified copy of 04/15/2021 Final Order with Mandate sent to the District Court Clerk. [7158796-2] [7158796] [21-1525] (DRS) [Entered: 05/07/2021 09:22 AM] |
Filing 14 ORDER: JoAnne Troesch and Ifeoma Nkemdi appeal the dismissal of their complaint alleging that the Board of Education of the City of Chicago and the Chicago Teachers Union violated the First Amendment by permitting union members to stop their dues payments only during an annual escape period. The parties agree that the outcome of Troesch and Nkemdis appeal is controlled by our recent decision in Bennett v. Council 31 of the American Federation of State County and Municipal Employees, 991 F.3d 724 (7th Cir. 2021), in which we held that it does not violate the First Amendment for a union to continue deducting dues that an employee voluntarily agreed to pay. Accordingly, IT IS ORDERED that the motion to dismiss is GRANTED and the judgment of the district court is summarily AFFIRMED. [ # 7 ] [ # 10 ] Michael S. Kanne, Circuit Judge; Diane P. Wood, Circuit Judge and David F. Hamilton, Circuit Judge. [14] [7154135] [21-1525] (ER) [Entered: 04/15/2021 09:48 AM] |
