Filing 4 IT IS ORDERED that this appeal is DISMISSED for failure to pay the required docketing fee pursuant to Circuit Rule 3(b). The appellant shall remit to the clerk of the district court the $505 appellate fees. Mandate issued, no record to be returned. The appellant has neither paid the $505 appellate fees nor filed a motion to proceed on appeal in forma pauperis in the district court.[4][7188731] [21-2421] (CM) [Entered: 09/29/2021 09:01 AM] |
FOR COURT USE ONLY: Certified copy of 09/29/2021 Final Order with Mandate sent to the District Court Clerk. [7188737-2] [7188737] [21-2421] (CM) [Entered: 09/29/2021 09:05 AM] |
Filing 3 ORDER re: Motion for Appointment of Counsel and to Waive All Fees. [ # 2 ] This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings will remain suspended until the appellant's fee status has been determined. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). Because the appellant's fee status remains pending, the motion to appoint counsel is DENIED without court action, pursuant to the fee notice and order dated 08/03/2021. To the extent that the appellant seeks to proceed on appeal in forma pauperis, his paperwork is incomplete because it does not include an asset affidavit or a six-month prison trust fund statement. Accordingly, the appellant either pay the $505.00 appellate fees or file a motion for leave to proceed on appeal in forma pauperis and a six-month prison trust fund statement in the district court by 09/13/2021. The clerk shall send the appellant an asset affidavit form. Finally, the appellant shall file his Circuit Rule 3(c) docketing statement by September 13, 2021. The clerk shall send the appellant this courts instructions for preparing a docketing statement so the appellant may familiarize himself with the information that must be included in a Circuit Rule 3(c) docketing statement.
