March 17, 2022 Opinion or Order Filing 8 ORDER re: Notice of Resolution. Counsel for the appellant has filed a notice that the parties have resolved this case, but does not explain what should happen to this appeal. Accordingly, appellant shall file, by 03/31/2022, a statement of position explaining whether this appeal should proceed to resolution of his motion to proceed in forma pauperis, or a motion for voluntary dismissal that complies with Federal Rule of Appellate Procedure 42(b). The appellant is reminded that the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees. See 28 U.S.C. 1915(b). January 25, 2022 Opinion or Order Filing 3 ORDER: Further review of the district court docket shows that this appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). On January 19, 2022, the district court denied the appellants motion to appeal in forma pauperis because he did not submit the required trust fund account statement. This courts docket reflects that the appellant filed a motion to proceed in forma pauperis on January 24, 2022. To the extent that the appellant seeks leave to proceed on appeal in forma pauperis, his paperwork is incomplete because it does not include a PLRA memorandum. Accordingly, IT IS ORDERED that the appellant shall file the required memorandum by February 15, 2022. Alternatively, the appellant may seek to renew his motion to appeal in forma pauperis in the district court, accompanied by the necessary documents.
