May 6, 2022 Opinion or Order Filing 7 ORDER: On April 23, 2020, this court recognized that Marlon Watford has had three cases or appeals dismissed as frivolous, malicious, or for failure to state a claim and thus is not permitted to proceed in forma pauperis unless he is under imminent danger of serious physical injury. See 28 U.S.C. 1915(g). On May 6, 2022, the district court granted Watford leave to proceed in forma pauperis on appeal, but did not acknowledge Watfords three-strike status or address whether he is under imminent danger of serious physical injury. Notably, Watford received his third strike after filing the underlying case in the district court. In order to permit the appeal to proceed, it is requested that the district court determine whether Watford is under imminent danger of serious physical injury. If so, it is requested that the district court also assess an initial partial filing fee for the appeal and to notify this court when the partial fee has been collected. See 28 U.S.C. 1915(b)(1).
