June 2, 2022 Opinion or Order Filing 5 ORDER: We therefore issue this SUPPLEMENTAL CERTIFICATE OF APPEALABILITY. The parties must address two issues: (1) whether trial counsel was ineffective for not arguing that the 1,034 days Conner spent in pretrial detention violated his Sixth Amendment right to a speedy trial; and (2) whether state postconviction counsel committed an extraordinary error that warrants equitable tolling of the federal-petition deadline, specifically by affirmatively misrepresenting to Conner the filing deadline for any federal petitioneven though counsel conducted no independent research on the question, relied on an informal exchange with an outside attorney, and had not agreed to represent Conner in federal proceedings. Because the court would benefit from counseled briefing and oral argument, we also sua sponte APPOINT COUNSEL for Conner. An order designating counsel and setting a briefing schedule will follow.
