Filing 9 ORDER re: Motion to Remand Back to Distirct Court and Change Case Type to Personal Injury Case and Motion to Stay Proceedings [ # 8 ] This court ordered appellant Valerie Flores to file a memorandum addressing why this appeal should not be dismissed for lack of jurisdiction because she appeared to appealing from a non-final order. Flores has not responded to that order, and instead filed a motion to remand. Flores appealed from the district courts order determining that it lacked jurisdiction to review her amended complaint due to a pending appeal. Two weeks later, the district court screened Floress amended complaint and allowed her to proceed against two defendants. The district court then stayed proceedings pending resolution of this appeal. The district courts order is not a final order, see 28 U.S.C. 1291, nor is it the type of interlocutory decision over which this court has jurisdiction, see id. 1292(a), (b).
