ORDER: On consideration of the papers filed in this appeal and review of the short record, this appeal is DISMISSED for lack of jurisdiction. Appellate courts may review non-final orders denying qualified immunity. Lovelace v. Gibson, 21 F.4th 481, 487 (7th Cir. 2021). But there has been no denial here; the district court did not address qualified immunity at all. Without a passage in the district courts opinion addressing the contested issue, there is no collateral order to review. Id. Claims of immunity must be resolved at the earliest stage of litigation. Pearson v. Callahan, 555 U.S. 223, 232 (2009) (internal citation omitted). As a result, we trust that the district court will, before trial, answer the qualified immunity question by considering whether the evidence would allow a reasonable jury to conclude that any of the defendants violated Ryan Mitchells clearly established constitutional rights.
