Date Filed Document Text
December 13, 2022 Opinion or Order Filing 9 ORDER re: Appellant's Motion for Certificate of Appealability. Because this appeal may proceed without a certificate of appealability, the appellant's motion will be filed without further court action. The appellant is reminded that this appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellant's fee status has not yet been determined. The appellant must file the required PLRA memorandum by January 3, 2023. Failure to do so may result in the dismissal of this appeal. Sent Certified Mail. Receipt Number: 7019 2280 0001 7854 9399. December 1, 2022 Filing 5 Filed District Court order DENYING Appellant Richard E. Hull leave to proceed on appeal in forma pauperis. Date IFP denied: 12/01/2022. Mr. Hull's motion is granted to the extent that the clerk is directed to terminate (Motion for Certificate of Appealability), and (Motion to Stay Proceedings) as withdrawn. The motion is denied to the extent that it seeks dismissal of the appeal pending before the Seventh Circuit under USCA Case Number 22- 2848 because this Court lacks jurisdiction to dismiss a case pending before the Seventh Circuit. November 15, 2022 Opinion or Order Filing 4 ORDER re: Motion to withdraw notice of appeal forma pauperis and certificate of appealability, filed on 11/14/2022. Federal Rule of Appellate Procedure 42(b) allows an appellant to voluntarily dismiss his appeal. However, voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). Because it appears that the appellant would like to be relieved of the obligation to pay the remaining $500.00 appellate fees, The motion is DENIED without prejudice to renewal. Should the appellant decide that he does not want to proceed with this appeal, he may file a renewed motion that complies with Federal Rule of Appellate Procedure 42(b). Any such motion is due by December 13, 2022. The appellant is reminded that if a party files a notice of appeal after the court enters a judgment but before it resolves a motion to alter or amend the judgment, the notice of appeal becomes effective to appeal the judgment when the order disposing of the motion is entered. See Fed. R. App. P. 4(a)(4)(B). [ # 3 ] [4] [7273530] CDH [22-2848] (FP) [Entered: 11/15/2022 03:09 PM]
