ORDER re: Motion to withdraw as appellants counsel on appeal. The district court appointed Spencer Lee Daniels to represent the petitioner in this case under 28 U.S.C. 2255. After the district court denied the petitioners 2255 motion, counsel filed a notice of appeal. Attorney Daniels now moves to withdraw as counsel, and he asks us to appoint new counsel for the petitioner-appellant. Attorney Danielss representation is terminated and that his name be removed from the docket. This appeal shall proceed to a determination of whether a certificate of appealability should issue. The request for appointment of counsel will be considered along with the petitioner-appellants request for a certificate of appealability.
