ORDER: Emergency Motion for Stay and a Restraining Order Under FRCP Rule 65; Petition for a Writ of Mandamus, Compelling the Trial Judge to Transfer the Case, Compelling the Federal Trial Court to Hold a Hearing. This court construes John Puchner's petition for a writ of mandamus as a notice of appeal for case No. 3:23-cv-00183 in the District Court for the Western District of Wisconsin. Accordingly, the clerk of this court shall transfer the petition to the district court to be docketed as a notice of appeal. Puchner is warned that it is frivolous to petition for a writ of mandamus in a case in which final judgment has been entered and that the proper means of seeking review is through a notice of appeal.
