Filing 4 ORDER: On June 15, 2023, the appellant filed a notice of appeal from the district court's judgment, and appeal no. 23-2199 was opened. On June 22, 2023, the appellant filed another notice of appeal and a second appeal, 23-2238, was opened. The notices of appeal in 23-2199 and 23-2238 both seek to challenge the same district court judgment, and two separate appeals are not necessary. Accordingly, IT IS ORDERED that appeal no. 23-2238 is administratively CLOSED. No appellate filing fees for appeal no. 23-2238 shall be imposed. On July 7, 2023, the appellant filed a third notice of appeal after the district court denied his motion to alter or amend the judgment, and appeal no. 23-2348 was opened. Because the motion to alter or amend was filed within 28 days of the judgment, no additional fee is required to file an appeal from the order denying the motion. See Fed. R. App. P. 4(a)(4)(B)(iii). Accordingly, IT IS FURTHER ORDERED that no additional filing fee is due for appeal no. 23-2348. [4] [7322708] [23-2199, 23-2238, 23-2348] (ER) [Entered: 07/11/2023 04:02 PM] |
