ORDER: This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellant's fee status has not yet been determined. Further, a review of the district courts docket shows that no appellees nor attorney for the appellees filed an appearance in the district court before the district court entered its final order and judgment. Because no appellees or counsel for the appellees were served by the district court or made an appearance in that court, there are no appellees involved in this appeal. Also, once the appellants fee status has been determined, this appeal may proceed without a certificate of appealability. Accordingly, IT IS ORDERED that the court will take no action on the appellants motion for a certificate of appealability. IT IS FURTHER ORDERED that the motion for appointment of counsel is DENIED without court action, pursuant to this courts fee notice and order dated July 25, 2023.
