This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Specifically, on August 18, 2023, the district court denied the appellants motion for leave to proceed on appeal in forma pauperis. The deadline for appellant to either pay the $505.00 appellate filing fees in the district court or file a motion for leave to proceed on appeal in forma pauperis and PLRA memorandum in support with the clerk of this court is September 18, 2023. Also, once the appellants fee status has been determined, this appeal may proceed without a certificate of appealability. Accordingly, IT IS ORDERED that the court will take no action on the appellants motion for a certificate of appealability. IT IS FURTHER ORDERED that the motion for appointment of counsel is DENIED without court action, pursuant to this courts fee notice and order dated August 1, 2023.
