FOR COURT USE ONLY: Certified copy of 08/18/2023 Final Order with Mandate sent to the District Court Clerk. [7334758-2] [7334758] [23-2611] (CAH) [Entered: 09/11/2023 12:14 PM] |
Filing 5 ORDER re: 1. Defenses Request for a Stay Order on the District Courts August 29, 2023, [Mistrial] Makeup Trial [ # 2 ]. 2. Governments Response in Opposition to Motion to Stay Trial [ # 4 ]. the motion is DENIED and that this appeal is DISMISSED for lack of jurisdiction. Ordinarily, a defendant in a criminal case may not take an appeal until a judgment of conviction and sentence has been entered. See Flanagan v. United States, 465 U.S. 259, 263 (1984); United States v. Kaufman, 951 F.2d 793, 794 (7th Cir. 1992). Defendant-appellant Thomas Zajac appeals, for a fourth time, a pretrial order, this time the order entered on August 10, 2023. But, importantly, Zajac has been neither convicted nor sentenced for the federal crimes he is charged with having committed. There is no exception to the general rule requiring review at final judgment for orders seeking to enforce a right to a speedy trial. See United States v. MacDonald, 435 U.S. 850, 861 (1978); United States v. Bokhari, 757 F.3d 664, 668 (7th Cir. 2014). Zajac is set to go to trial on August 29, 2023. Now is not the time to appeal this order. Diane P. Wood, Circuit Judge; Michael B. Brennan, Circuit Judge and Amy J. St. Eve, Circuit Judge. [5] [7330503] [23-2611] (MAN) [Entered: 08/18/2023 11:25 AM] |
