January 24, 2024 Opinion or Order Filing 3 ORDER re: Plaintiffs Request to Reconsider/Appeal Order to Dismiss Entered by the Court [ # 2 ]. This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellant's fee status has not yet been determined. Specifically, the deadline for the appellant to either pay the $605.00 required appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court is 02/12/2024. Accordingly, to the extent that the appellant seeks an extension of time, IT IS ORDERED that the appellant shall either pay the $605.00 required appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court by 02/26/2024. Failure to comply with this order may result in the dismissal of this appeal. Further, the appellant is reminded that this appeal is subject to the Prison Litigation Reform Act and therefore the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees and voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). IT IS FURTHER ORDERED that the appellant shall also file his Circuit Rule 3(c) docketing statement by 02/26/2024. IT IS FINALLY ORDERED that any other relief requested in the appellants motion is DENIED, without court action, pursuant to this courts fee notice and order dated 01/12/2024. A review of the district courts docket indicates that on 01/22/2024, the district court denied the appellants motion to reconsider. Sent Certified Mail. Receipt Number: 7021 2720 0001 0402 8156.
