A review of the docket shows that the appellants in forma pauperis status carried over for purposes of appeal. Accordingly, the motion to proceed on appeal in forma pauperis is DENIED as unnecessary. Further, this appeal may not proceed without a certificate of appealability. Because the appellants request for a certificate of appealability is currently pending before this court, no briefs are due at this time. Accordingly, to the extent that the appellant seeks an extension of time to file his brief, IT IS FURTHER ORDERED that the motion is DENIED. The appellant is reminded that the court will set a briefing schedule automatically should it grant his request for a certificate of appealability. If the appellant would like to file a separate request for a certificate of appealability with this court, he may do so by 03/13/2024. In the event that the appellant does not file a motion by that date, his notice of appeal previously docketed in this court will be deemed to constitute an application for a certificate of appealability. See Fed. R. App. P. 22(b)(2). IT IS FINALLY ORDERED that the appellant may submit one copy of papers filed with the court. A review of the district courts docket shows that no appellee nor attorney for the appellee filed an appearance in the district court before the district court entered its final order and judgment. Because no appellee or counsel for the appellee were served by the district court or made an appearance in that court, there is no appellee involved in this appeal. The appellant does not need to serve copies of his filings on the appellee unless counsel for the appellee files an appearance in this court.
