April 16, 2024 Opinion or Order Filing 24 ORDER: Defendant-appellant Hytera has filed a renewed emergency motion for a stay of contempt sanctions pending appeal and an administrative stay. We grant Hyteras motion to the extent that we stay, effective immediately, the $1-million-per-day fine, the worldwide ban on two-way radio sales by Hytera, and the worldwide notice requirement. Accordingly, effective immediately, we STAY the contempt sanctions of the worldwide sales injunction, the worldwide notice requirement, and the further accumulation of the $1-million-per-day fines. This order has no effect on the contempt orders provision barring Hytera from using any favorable ruling from the Shenzhen action to its benefit. We commend the district court for its close attention and careful work in this case. If at some future time the Shenzhen court issues a written order that appears to enable any further proceedings in the H-Series matter, and/or if Hytera seeks to take advantage of some future written order or other action by the Shenzhen court, nothing in this order is intended to limit the district courts ability to take appropriate action to enforce its injunctions. In this appeal, No. 24-1531, appellant Hyteras opening brief shall be filed no later than 28 days from the date of this order. The Motorola appellees opposing brief shall be filed no later than 28 days after Hytera files its brief.
