ORDER re: Motion to appoint counsel. IT IS ORDERED that the motion will be ruled on at a later date. Attorney Donald J. Schmid is directed to assist defendant with filing in the district court (and, if denied, in this court) a motion to proceed on appeal in forma pauperis. See Fed. R. App. P. 24(a). Counsel shall file, on or before May 29, 2024, a Status Report regarding his compliance with this order, attaching a copy of the district courts decision on defendants motion to proceed in forma pauperis on appeal if available. IT IS FURTHER ORDERED that attorney Schmid comply with the provisions of Fed. R. App. P. 10(b) regarding the preparation of the transcripts of defendant-appellant Kenneth Thomas plea and sentencing hearings. Counsel shall also file a statement regarding the preparation of the transcripts by May 29, 2024. Briefing is SUSPENDED pending further court order.
