ORDER: In the present case, appellant filed a motion to alter or amend the judgment on June 10, 2024, though it was postmarked on May 29, 2024, within 28 days of entry of judgment on May 2, 2024. The motion therefore appears to be timely. See Edwards v. United States, 266 F.3d 756, 758 (7th Cir. 2001) (extending mailbox rule to motions to alter or amend judgment). As such, this appeal may be premature, because it appears that the district court has not disposed of the motion and entered its order on the civil docket. Florian v. Sequa Corp., 294 F.3d 828, 829 (7th Cir. 2002). Accordingly, appellant shall file, on or before July 15, 2024, a brief memorandum stating why this appeal should not be STAYED pending the entry of the order disposing of the motion. A motion for voluntary dismissal pursuant to Fed. R. App. P. 42(b) will satisfy this requirement. Briefing is SUSPENDED pending further court order.
