ORDER re: Motion to correct the record, filed on 9/3/2024. This appeal is subject to the Prison Litigation Reform Act and therefore the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees and voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). Further, a review of the district court docket shows that the appellant filed different notices of appeal on August 12, 2024, and on August 13, 2024. Accordingly, to the extent that the appellant seeks to withdraw his second appeal, the motion is DENIED without prejudice to renewal. Should the appellant decide that he does not want to proceed with this appeal, he may file a renewed motion that complies with Federal Rule of Appellate Procedure 42(b). Any such motion is due by October 7, 2024. If the appellant does not file a compliant motion to voluntarily dismiss, this appeal will proceed to a ruling on his motion for leave to proceed on appeal in forma pauperis, filed on September 3, 2024.
