ORDER: A preliminary review of the short record indicates that the order appealed from may not be a final appealable judgment within the meaning of 28 U.S.C. 1291. Although the district court entered final judgment on April 25, 2024, appellant then filed a timely motion for reconsideration on May 21, 2024. The district court granted that motion (in part) on June 25, 2024, vacated the judgment, and directed appellant to file a renewed motion to proceed in forma pauperis and an amended complaint. This appeal appears to be premature because the district court has not yet entered a new final judgment disposing of all claims against all parties. See Alonzi v. Budget Construction Co., 55 F.3d 331, 333 (7th Cir. 1995); Cleaver v. Elias, 852 F.2d 266, 267 (7th Cir. 1988). Nor has the district court suggested that the case would be dismissed if appellant failed to tender the required motion and amended complaint before the deadline. Cf. Davis v. Advoc. Health Ctr. Patient Care Exp., 523 F.3d 681, 683 (7th Cir. 2008). Accordingly, IT IS ORDERED that appellant shall file, on or before September 9, 2024, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. A motion for voluntary dismissal pursuant to Fed. R. App. P. 42(b) will satisfy this requirement. Briefing is SUSPENDED pending further court order.
