ORDER re: 1. Plaintiff's motion for appointment of counsel. 2. Letter regarding transcript information sheet. [ # 4 ] This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellant's fee status has not yet been determined. Specifically, the appellants motion for leave to proceed on appeal in forma pauperis is currently pending before the district court. Accordingly, the motion for appointment of counsel is DENIED without court action, pursuant to the courts fee notice and order dated September 16, 2024. To the extent that the appellant seeks leave to use the original record, the appellant is reminded that the district court no longer transmits the record on appeal. Because the record is electronic, it is available for this court's use without the need for transmission of a physical record. Further, should this appeal proceed to briefing, the appellant may make any arguments he believes have merit in his opening brief and he need only attach the judgment or order under review to his opening brief.
