October 17, 2024 Opinion or Order Filing 10 ORDER re: Appellants' joint status report. In light of the amended judgment entered by the district court on October 11, 2024, this appeal will proceed to briefing. Briefing will proceed as follows: 1. The appellants shall file their briefs and required short appendices on or before November 15, 2024. 2. The appellees shall file their consolidated brief on or before December 16, 2024. 3. The appellants shall file their reply briefs, if any, on or before January 6, 2025. A review of the short records reveals that these appeals involve more than one appellant represented by different counsel. Counsel for appellants are encouraged to avoid unnecessary duplication by filing a joint brief or a joint appendix or by adopting parts of a co-appellants brief. Duplicative briefing will be stricken and may result in disciplinary sanctions against counsel. See United States v. Torres, 170 F.3d 749 (7th Cir. 1999); United States v. Ashman, 964 F.2d 596 (7th Cir. 1992). Appellants, however, may not adopt the Jurisdictional Statement of another. Each appellants brief must include a complete Jurisdictional Statement. October 10, 2024 Opinion or Order Filing 8 ORDER: These appeals are REMANDED to the district court to enter a judgment that fully and correctly implements its decision granting declaratory relief to the plaintiffs. See Fed. R. Civ. P. 60(a). This court will retain jurisdiction over these appeals. Once the district court has corrected its judgment, these appeals will proceed to briefing. An amended notice of appeal is unnecessary. See Mosley v. Atchison , 689 F.3d 838, 84344 (7th Cir. 2012). Appellants shall inform the court, on or before October 17, 2024, whether the district court has entered its amended judgment. September 20, 2024 Opinion or Order Filing 2 ORDER: The court, on its own motion, orders these appeals are CONSOLIDATED for purposes of briefing and disposition. A preliminary review of the short records indicates that the judgment is deficient. A judgment must provide relief to which the prevailing party is entitled. Hyland v. Liberty Mutual Fire Ins. Co. , 885 F.3d 482, 483 (7th Cir. 2018). The judgment entered in this case fails to do so. In this case, the clerk of courtnot the judgeentered and signed the judgment. In the judgment, the court states that judgment is entered in favor of the plaintiffs except that two defendants are terminated per order but it provides no relief to the plaintiffs. The parties have an obligation to ensure that the district court has issued a fully compliant Rule 58 judgment. Phila. Indemnity , 930 F.3d at 912. Accordingly, both appellants and appellees shall file, on or before October 4, 2024, a brief memorandum stating why these appeals should not be remanded to the district court to enter a proper judgment. Briefing is SUSPENDED pending further court order. (See order for further details) JXK [2] [7406777] [24-2643, 24-2644] (PS) [Entered: 09/20/2024 02:39 PM]
