ORDER re: Motion objecting to procedural disadvantages and requesting equitable relief. A review of the courts docket shows that the appellants in forma pauperis status carried over for purposes of appeal. To the extent that the appellant seeks an extension of time, the appellant shall file his overdue Circuit Rule 3(c) docketing statement by December 24, 2024. Failure to comply with this order may result in the dismissal of this appeal. Further, the court notes that the appellant has not been charged a fine for failure to comply with Circuit Rule 3(c). Finally, any transcript information sheet, if one is necessary, is also due by December 24, 2024. Based on a review of the district courts docket, however, it appears that no hearings were held. Any other relief requested in the appellants motion will be filed without further court action. ORDER: The district court construed appellants motion to toll appeal period as a timely notice of appeal. See Smith v. Barry, 502 U.S. 244, 248 (1992). But a notice of appeal filed before the district court issues its ruling on a timely motion under Rule 59 of the Federal Rules of Civil Procedureor a motion under Rule 60 that was filed within the time to file a Rule 59 motionis ineffective until the order disposing of the motion is entered on the district courts civil docket. Fed. R. App. P. 4(a)(4). IT IS ORDERED that proceedings in this appeal are SUSPENDED pending the district court's resolution of the motion for reconsideration.
