Date Filed Document Text
July 30, 2025 Opinion or Order Filing 26 ORDER re: Plaintiff-Appellant Motion for this Court of Appeals to Strike down the Defendants-Appellees to Strike Down the Defendants-Appellees Brief in this Appeal, Because it is in Violation of the Federal Rules of Civil Procedure Rule 5(d)(1)(A), which the court construes as a motion for extension of time to file the appellants reply brief. A review of the court's docket indicates that the appellees timely filed their brief on July 11, 2025. According to the certificate of service included with the appellees brief, counsel served the appellant through the U.S. Mail but used an incorrect address for inmate mail at Green Bay Correctional Institution. On July 28, 2025, the appellees filed a new certificate of service indicating a copy of the brief was mailed on July 28, 2025, to the appellant using the correct address. Accordingly, to the extent that the appellant needs additional time to file his reply brief, the appellants reply brief, if any, is due by August 20, 2025. April 4, 2025 Opinion or Order Filing 9 ORDER re: 1. Objection. 2. Motion to renew initial motion for appointment of counsel. [ # 8 ] A review of the courts docket shows that appellees Eileen S. Gavin and Wellhard, LLC are represented by attorney Jeffrey P. Nankervis. Accordingly, the appellants objection to the appearance of the Wisconsin Attorney General on behalf of the state defendants will be filed without further court action. Because the appellant indicates in his objection that this appeal does not involve any of the state defendants, the clerk will update the docket to reflect that Eileen S. Gavin and Wellhard, LLC are the only appellees on appeal. To the extent that the appellant seeks to reinstate his previous motion for appointment of counsel, the motion is DENIED. Appellant may file a renewed motion for appointment of counsel including reasons in support. The clerk will send the appellant a copy of the courts public docket.
