March 17, 2025 Opinion or Order Filing 2 ORDER: The court, on its own motion, orders these appeals are CONSOLIDATED for purposes of briefing and disposition. The briefing schedule is as follows: Appellant's consolidated brief due on or before 04/23/2025 for Group Health Cooperative of South Central Wisconsin. Appellees' briefs due on or before 05/23/2025 for Daniel Pearson, Margaret Hetzler, Gabriella Jenich, Lisa Mitchell, Sue Maurer, Michael Collins, Jennifer Johnson-Heiss, Mary Donahue and Maleah Moskoff. Appellant's consolidated reply brief, if any, is due on or before 06/13/2025 for Appellant Group Health Cooperative of South Central Wisconsin. A review of the short records reveals that these appeals involve more than one appellee represented by different counsel. Counsel for appellees are encouraged to avoid unnecessary duplication by filing a joint brief or a joint appendix or by adopting parts of a co-appellees brief. Duplicative briefing will be stricken and may result in disciplinary sanctions against counsel. See United States v. Torres , 170 F.3d 749 (7th Cir. 1999); United States v. Ashman , 964 F.2d 596 (7th Cir. 1992). In addition, Circuit Rule 3(c)(1), referencing Circuit Rule 28(a), requires an appellant to file a docketing statement which provides information concerning the district courts jurisdiction. If jurisdiction depends on diversity, the statement must identify the amount in controversy and establish the required diversity between the parties. In the present case, appellant states that the district court had jurisdiction based on the Class Action Fairness Act. See 28 U.S.C. 1332(d). Appellants Circuit Rule 3(c) docketing statements, however, each fail to identify the state of citizenship of at least one plaintiff proposed class member; it is insufficient to state only that some members of the class are citizens of states other than Wisconsin without identifying a specific members citizenship. See Dancel v. Groupon, Inc. , 940 F.3d 381, 385 (7th Cir. 2019). Accordingly, appellant shall file in each appeal an amended docketing statement that provides a complete statement of jurisdiction that includes the omitted information. The statements are due on or before March 24, 2025. JXK [2] [7440688] [25-1425, 25-1426, 25-1427, 25-1428, 25-1429, 25-1430, 25-1431] (PS) [Entered: 03/17/2025 12:36 PM]
