June 18, 2025 Opinion or Order Filing 4 ORDER: Rule 4(a) of the Federal Rules of Appellate Procedure requires that a notice of appeal in a civil case be filed in the district court within 30 days of the entry of the judgment or order appealed. In this case judgment was entered on May 6, 2025, and the notice of appeal was filed on June 11, 2025, and postmarked on June 9, 2025, four days late. The district court has not granted an extension of the appeal period, see Fed. R. App. P. 4(a)(5), and this court is not empowered to do so, see Fed. R. App. P. 26(b). Accordingly, appellant shall file, on or before July 2, 2025, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. The memorandum should also address whether appellants complaint, filed on May 27, 2025, may be construed as a timely notice of appeal, see Smith v. Barry, 502 U.S. 244, 248 (1992), or a timely motion to alter or amend the judgment, see Fed. R. Civ. P. 59; Carlson v. CSX Transp., Inc., 758 F.3d 819, 82526 (7th Cir. 2014). A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement. Briefing is SUSPENDED pending further court order. If appellant wishes to request an extension of time in which to file the notice of appeal, appellant should file an appropriate motion in the district court, not this court, as soon as possible. Appellants jurisdictional memorandum should include a discussion of the status of any such motion. IN THE ALTERNATIVE, appellant may file a notarized statement or declaration (in compliance with 28 U.S.C. 1746) setting forth the date the notice of appeal was deposited in the prisons internal mail system and stating whether first class postage was prepaid.
