February 26, 2026 Opinion or Order Filing 32 ORDER: Upon consideration of the appellants motions papers, the district courts order pursuant to 28 U.S.C. 1915(a)(3) certifying that the appeal was filed in bad faith, and the record on appeal, this court has determined that the district court erred in its bad-faith determination. This court recognizes that Jason Olrich has three strikes pursuant to 28 U.S.C. 1915(g). He has had at least three cases dismissed for failure to state a claim: Olrich v. City of Kenosha , No. 18-cv-1981-PP (W.D. Wis. July 30, 2019); Olrich v. Kenosha County , No. 18-cv-1982-PP (W.D. Wis. July 30, 2019); and Olrich v. Illichmann , No. 18-cv-1518-PP (W.D. Wis. Jan. 20, 2021). As the district court held, Olrich arguably demonstrated that he is in imminent danger of serious physical injury. And Olrich may be able to raise a non-frivolous argument that the district court erred in dismissing his case for lack of diligence. Accordingly, the motions for leave to proceed on appeal in forma pauperis are GRANTED. The district court is instructed to assess an initial partial filing fee for the appeal and to notify this court when the partial fee has been collected.
