Filing 16
ORDER: On consideration of the papers filed in this appeal and review of the short record, this appeal is LIMITED to a review of the district courts August 7, 2025, order denying appellant's motion for reconsideration. Rule 4(a) of the Federal Rules of Appellate Procedure requires that a notice of appeal in a civil case be filed in the district court within 30 days of the entry of the judgment or order appealed. In this case judgment was entered on May 5, 2025. Appellant moved for reconsideration on June 13, 2025. Because this motion was filed more than 28 days after the judgmenta deadline the district court could not extend, Fed. R. Civ. P. 6(b)(2)it did not suspend the time to appeal the judgment. See Fed. R. App. P. 4(a)(4); Blue v. Int'l Bhd. of Elec. Workers Loc. Union 159, 676 F.3d 579, 584 (7th Cir. 2012). The notice of appeal was then filed on September 6, 2025, over three months late with respect to the judgment. The district court has not granted an extension of the appeal period, see Fed. R. App. P. 4(a)(5), and this court is not empowered to do so, see Fed. R. App. P. 26(b). This appeal is timely with respect to only the district courts August 7, 2025, order. Accordingly, this appeal, as LIMITED by this order, shall proceed to a ruling on appellants motion to proceed on appeal in forma pauperis.
