ORDER re: Motion. The appellants pro se motion which responds to the courts order dated November 13, 2025, indicates that he does not wish for retained counsel, Jennifer H. Culotta to continue as his attorney and states I wish to end my appeal. Federal Rule of Appellate Procedure 42(b) allows an appellant to voluntarily dismiss his appeal. However, once the appeal is dismissed, the appellant cannot reinstate it at a later date. Because it is unclear whether the appellant seeks to unconditionally dismiss this appeal, the request is DENIED without prejudice to renewal. Further, because the appellant is represented by counsel any motion should be made by and through his attorney. Should the appellant decide that he does not want to proceed with this appeal, counsel should file a motion to voluntarily dismiss that complies with both Federal Rule of Appellate Procedure 42(b) and Circuit Rule 51(e) and be accompanied by an acknowledgement and consent form signed by the appellant. Any renewed motion is due by January 5, 2026. If the appellant decides to proceed with this appeal, he shall either pay the $605.00 appellate filings fees in the district court or file a motion for leave to proceed on appeal in forma pauperis with the clerk of this court by January 5, 2026.
