ORDER re: Motion. This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellants fee status has not yet been determined. Accordingly, to the extent that the appellant seeks recruitment of counsel, request is DENIED without court action, pursuant to this courts fee notice and order dated October 31, 2025. To the extent that the appellant seeks copies of record items, that request should be made in the district court. [ # 14 ] [15] [7516193] CDH [25-2958] (HTP) [Entered: 04/08/2026 09:58 AM]

ORDER: On March 9, 2026, the appellant filed a motion for leave to proceed on appeal in forma pauperis, which the court will construe as an implied request to recall the mandate. Construed as such, the request to recall the mandate is GRANTED. The final order dated January 23, 2026, is VACATED, the mandate is RECALLED, and this appeal is REINSTATED. To the extent that the appellant seeks to proceed on appeal in forma pauperis, his paperwork is incomplete because it does not include the required PLRA memorandum. In his memorandum, the appellant should explain why he believes the district courts denial of leave to appeal in forma pauperis was erroneous. ORDER Re: Motion for Cause In Regards to January 23, 2026 Order, which the court construes as a motion to recall the mandate. On October 27, 2025, appellant filed a document in the district court titled Notice of Appeal. The appellant is reminded that this appeal is subject to the Prison Litigation Reform Act and therefore the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees and voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). Accordingly, the request to recall the mandate is DENIED without prejudice to renewal in a motion that includes either confirmation that the appellant paid the $605.00 appellate filings fees in the district court or a tendered motion for leave to proceed on appeal in forma pauperis together with a PLRA memorandum in support. Any renewed motion is due by March 9, 2026. [ # 7 ] [8] [7502821] CDH [25-2958] (AD) [Entered: 02/05/2026 10:48 AM]
