ORDER Re: Memorandum of Law in Support of Defendant's Motion to Vacate Detention Order and for Pretrial Release. 2) Government's Response to the Defendant's Motion to Vacate Detention Order. The request to vacate the district court's detention order is GRANTED. This appeal is REMANDED to the district court so the court may consider, in the first instance, whether there are any conditions or combinations of conditions of release that will reasonably assure appellant Jamar Scott's appearance and the safety of the community. See 18 U.S.C. 3142(e). Although the district court concluded that Scott was likely to commit more crimes if released, posing a danger to the community, United States v. Daniels, 772 F.2d 382, 383 (7th Cir. 1985), detention is appropriate only if no conditions of release would reasonably assure his appearance and the community's safety. The district court must assess possible conditions of release in the first instance. See United States v. Wilks, 15 F.4th 842, 848 (7th Cir. 2021); United States v. Infelise, 934 F.2d 103, 105 (7th Cir. 1991); 18 U.S.C. 3142(e). A statement that detention is necessary, without explanation or analysis, does not suffice. Wilks, 15 F.4th at 848. Further, the request for pretrial release is DENIED. If the district court determines that sufficient conditions of release exist, then the district court shall issue an order releasing the appellant from custody subject to those conditions.
