ORDER: A preliminary review of the short record suggests that this appeal may be frivolous. The district court dismissed this case as frivolous under 28 U.S.C. 1915(e)(2)(B), observing that appellants claims all squarely fall within the scope of defendants prosecutorial immunity, but the court granted permission to proceed on appeal in forma pauperis. See 28 U.S.C. 1915(a)(3); Fed. R. App. P. 24(a)(3). [T]he granting of leave to appeal in forma pauperis from the dismissal of a frivolous suit is presumptively erroneous and indeed self-contradictory and such an appeal should be dismissed summarily. Tolefree v. Cudahy, 49 F.3d 1243, 1244 (7th Cir. 1995); see also Lee v. Clinton, 209 F.3d 1025, 1026 (7th Cir. 2000). Accordingly, IT IS ORDERED that appellant shall file, on or before January 30, 2026, a brief memorandum stating why this court should not revoke permission to appeal in forma pauperis and dismiss this appeal as frivolous. See 28 U.S.C. 1915(e)(2)(B)(i). A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement.
