December 31, 2025 Opinion or Order Filing 6 ORDER re: Motion to dismiss appeal and waive both filing fees. [ # 5 ]; Federal Rule of Appellate Procedure 42(b) allows an appellant to voluntarily dismiss his appeal. However, the appellant is again reminded that this appeal is subject to the Prison Litigation Reform Act and therefore the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees and voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). The district courts docket reflects that the appellant filed one notice of appeal on November 19, 2025. According to this courts Miscellaneous Fee Schedule dated December 1, 2023, the fee for docketing a case on appeal or review is $600.00. There is an additional statutory fee of $5.00 that is collected under 28 U.S.C. 1917. Because it appears that the appellant would like to be relieved of the obligation to pay the appellate fees, the motion is DENIED without prejudice to renewal. Should the appellant decide that he does not want to proceed with this appeal, he may file a renewed motion that complies with Federal Rule of Appellate Procedure 42(b). Any such motion is due by January 30, 2026. If the appellant does not file a compliant motion to voluntarily dismiss, he shall either pay the $605.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court by January 30, 2026.
