ORDER: On consideration of the papers filed in this appeal and review of the short record, this appeal is DISMISSED for lack of jurisdiction. Rule 4(a) of the Federal Rules of Appellate Procedure and 28 U.S.C. 2107(b) require that a notice of appeal be filed in the district court within 60 days of the entry of the judgment or order appealed in a civil case in which a party is the United States or one of its agencies, officers, or employees. In this case judgment was entered on September 19, 2025, and the notice of appeal was filed on November 24, 2025, six days late. Although appellant Ryan Sopha asserts the notice of appeal was mailed on time, neither appellant is an inmate confined in an institution within the meaning of Rule 4(c) of the Federal Rules of Appellate Procedure and so cannot rely on the mailing date. Regardless, the notice of appeal was mailed on November 19, 2025, still one day late. The district court has not granted an extension of the appeal period, see Fed. R. App. P. 4(a)(5), nor has it reopened the time to appeal, see Fed. R. App. P. 4(a)(6), and this court is not empowered to do either, see Fed. R. App. P. 26(b). David F.
