ORDER: Circuit Rule 3(c)(1), referencing Circuit Rule 28(a), requires an appellant to file a docketing statement that provides information concerning appellate jurisdiction. In the present case, appellants Circuit Rule 3(c) docketing statement fails to set forth the date on which the plaintiff filed its posttrial motions. Appellant must provide this information to establish that the motions were filed within 28 days of the entry of the judgment, and therefore that the appeal is timely. Cir. R. 28(a)(2)(ii). The court further notes that the date relevant to most appellate deadlines is the date that judgment was entered on the docket, Fed. R. Civ. P. 58(c), and that this date may not always align with the date the judgment was filed. Accordingly, appellant shall file an amended docketing statement that provides a complete statement of jurisdiction that includes the omitted information and any necessary corrections.
