May 7, 2026 FOR COURT USE ONLY: Certified copy of 05/07/2026 Final Order with Mandate sent to the District Court Clerk. [7523893-2] [7523893] [26-1006] (CAG) [Entered: 05/07/2026 11:07 AM]
March 6, 2026 Opinion or Order Filing 5 ORDER re: Appellee, Doctor Lars Gentry's motion to dismiss appeal. The appellant shall file by March 20, 2026, a response to appellee Lars Gentrys motion to dismiss. If the appellant does not want to proceed with this appeal, he may file a motion to voluntarily dismiss this appeal that complies with Federal Rule of Appellate Procedure 42(b). The appellant is reminded that this appeal is subject to the Prison Litigation Reform Act and therefore the filing of a notice of appeal triggers the obligation to pay the appropriate filing fees and voluntary dismissal does not relieve the appellant of the obligation to pay the appellate filing fees. See 28 U.S.C. 1915(b). Further, once the appeal is dismissed, the appellant cannot reinstate it at a later date. The deadline for the appellant to either pay the $605.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court is extended to April 6, 2026. January 23, 2026 Opinion or Order Filing 3 ORDER re: Motion for appointment of counsel. [ # 2 ] This appeal is subject to the Prison Litigation Reform Act and therefore all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellants fee status has not yet been determined. Specifically, the deadline for the appellant to either pay the $605.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court is February 4, 2026. Accordingly, to the extent that the appellant seeks appointment of counsel, the motion is DENIED without court action, pursuant to this courts fee notice and order dated January 5, 2026.
