May 7, 2026 Opinion or Order Filing 5 ORDER: The court, on its own motion, orders appellant to show cause for the failure to respond to the court's order of April 14, 2026. Appellant shall file a response to that order on or before May 21, 2026. Appellants response should explain why, if this court has jurisdiction over this appeal, it should not be dismissed as unnecessary because it duplicates appeal No. 26-1978. A party needs only one appeal from any given judgment or order, and the other should be dismissed. Grunt Style LLC v. TWD, LLC, 140 F.4th 839, 845 (7th Cir. 2025); Harris v. Bellin Meml Hosp., 13 F.3d 1082, 1083 (7th Cir. 1994). Appellant is advised that failure to respond may result in the dismissal of this appeal. The clerk of this court shall attach a copy of the April 14, 2026, order to appellant's copy of this order. JXK Sent Certified Mail. Receipt Number: 9589 0710 5270 1810 9554 71. April 30, 2026 Opinion or Order Filing 3 ORDER: Appellant Jimmy L. Bynum, Jr. is directed to file the overdue Docketing Statement within 14 days from the date of this Rule to Show Cause. AD. April 14, 2026 Opinion or Order Filing 2 ORDER: A preliminary review of the short record suggests that the order appealed from may not be a final decision within the meaning of 28 U.S.C. 1291. Generally, an appeal may not be taken in a civil case until a final judgment disposing of all claims against all parties is entered on the district courts civil docket pursuant to Rule 58 of the Federal Rules of Civil Procedure. See Alonzi v. Budget Construction Co., 55 F.3d 331, 333 (7th Cir. 1995); Cleaver v. Elias, 852 F.2d 266, 267 (7th Cir. 1988). In this case, appellant seeks to appeal after a jury verdict and various decisions regarding the scope of damages, but the parties appear still to dispute the amount of prejudgment interest and the district court has not yet resolved that dispute. Prejudgment interest is a component of the plaintiffs damage, and the court has not reached a final decision until it fully quantifies those damages. Dual-Temp of Illinois, Inc. v. Hench Control, Inc., 777 F.3d 429, 430 (7th Cir. 2015). Accordingly, appellant shall file, on or before April 28, 2026, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement. Briefing is SUSPENDED pending further court order.
