ORDER: A preliminary review of the short record suggests that this appeal is unnecessary. Appellant seeks review of the district courts order denying leave to proceed on appeal in forma pauperis and a certificate of appealability. Rule 24(a)(5) of the Federal Rules of Appellate Procedure directs that an appellant should refile a motion to proceed in forma pauperis within the appeal from the judgment, here appeal No. 26-1272. Likewise, Rule 11(a) of the Rules Governing Section 2254 Cases provides that a party may not appeal the denial of a certificate of appealability but may instead seek a certificate from the court of appeals under Rule 22 of the Federal Rules of Appellate Procedure. In either circumstance, it is not necessary to file a separate appeal. Accordingly, the appellant shall file, on or before April 30, 2026, a brief memorandum stating why this appeal should not be dismissed as unnecessary. A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement. Briefing is SUSPENDED pending further court order.
