ORDER re: Appellant's motion to designate paid track no. 26-2123 as the sole unified vehicle governing all appellate merits and to dismiss co-member track no. 26-2028. Appellant Keith Powell filed two appeals, which this court has consolidated. No. 26-2028 is an appeal from the district courts summary judgment order and final judgment, and no. 26-2123 is from the district courts order denying relief from the judgment. Powell asks to voluntarily dismiss appeal no. 26-2028 without prejudice and to proceed on appeal no. 26-2123. Federal Rule of Appellate Procedure 42(b) allows an appellant to voluntarily dismiss his appeal. However, once the appeal is dismissed, the appellant cannot reinstate it at a later date. If appeal no. 26-2028 is dismissed, Powells arguments on appeal will be limited to the order denying relief from the judgment. See Fed. R. App. P. 4(a)(4); Gleason v. Jansen, 888 F.3d 847, 851 (7th Cir. 2018). Because it is unclear that Powell wants to voluntarily dismiss appeal no. 26-2028, the motion is DENIED. Should Powell decide that he does not want to proceed with appeal no. 26-2028, he may move to voluntarily dismiss pursuant to Fed. R. App. P. 42(b). If Powell does not file a compliant motion to voluntarily dismiss appeal no. 26-2028, he must either pay the $605.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court by August 17, 2026.
